DECIDE praises the Constitutional Council's ruling and considers the decision a "milestone" for democracy in Mozambique

The DECIDE Platform publicly expressed its full support this week for the Constitutional Council's decision declaring parts of the Regulation on Telecommunications Traffic Control unconstitutional. According to the organization, the opinion of the oversight body not only corrects a legal deviation but also consolidates citizens' trust in the country's democratic institutions.

In response to Ruling No. 6/CC/2026, of July 29, which challenged several provisions of Decree No. 48/2025, of December 18, DECIDE underlines that the measure represents an "important sign of institutional maturity" and a reflection of the proper functioning of the rule of law in Mozambique.

From the organization's perspective, by setting clear limits on the Executive's actions and reaffirming the exclusive competence of the Assembly of the Republic to legislate on certain matters, the Constitutional Council provided a crucial service to the supremacy of the Constitution. "Decisions of this nature demonstrate that issues of high public sensitivity can and should be addressed through the legal mechanisms provided for in our legal system," reads the official statement, which also highlights the strengthening of the culture of accountability and oversight.

Beyond acknowledging the work of the Court, DECIDE emphasized the proactive role of the Ombudsman in exercising his constitutional mandate, as well as the contribution of the Center for Democracy and Human Rights (CDD) and other civil society organizations. The platform recalls that the joint effort in civic mobilization and the collection of signatures that enabled this oversight process was fundamental.

Finally, the organization reaffirms its unwavering commitment to defending human rights and fundamental freedoms, calling for future legislative initiatives with a direct impact in these areas to be preceded by broad public consultation, transparency, and strict adherence to the Constitution. DECIDE thus encourages all political and social actors to pursue institutional dialogue to guarantee stability and justice in the communications sector and beyond.
