Alberto Pereira violates Podemos Statute Precautionary measure considered unethical…

There is a bad atmosphere in the second most voted party in Mozambique as a logical consequence of the frustrated race of the first elections aimed at electing the figure of Secretary General of the Party, which took place in the city of Maputo and ended with an exchange of accusations and beatings between the candidates. At the event, Alberto Pereira, member and vice-president of the Political Dialogue Commission for Podemos according to the percentage metrics, was considered the winner without observing the Statutes that govern the Party.

According to a source from the Party who spoke to our reporter, after the unrest, Pereira declared his withdrawal and later filed a precautionary measure demanding that the courts and/or tribunal declare him the winner of this case. At this point, he is considered negligent by his colleagues for not knowing the Party's internal procedure, but even so, according to the Party's Statutes, the vote will not go ahead to a second round. Note that the decision to hold the second round was not made by the Party's president, but rather by the plenary session of the central council, through a vote.

The same source considers that Alberto Ferreira had 37%, against the 63% distributed among the 3 candidates. If the three (3) candidates formed a coalition, then Ferreira would lose the elections because the majority was with the three (3). That is why the second round is being held.

To ensure this practice, the Party relied on the legal instrument, the Boletim Da Republica (BR), which we also have the statutes, but in the case of elections, the statutes are silent, meaning the issue of time is not included. So, the electoral commission, during the voting process, determined that we would go to a second round, let's say, after the vote, and then they would hold a second round.

Because we do not recognize this, since we have a Statute that governs the party, it is the first time in the party's democracy that four candidates will be put to the vote. So, it is in this sense that this precaution was not taken. Even the president himself was surprised to see four candidates, it is the first time that this has happened.

However, this issue of two or three candidates was still omitted. We are currently working on reviewing the Statutes.

So, to say that we have a gap, we do not have a simple item, we have a Statute that is silent on this issue.

We have a democracy in the party, so there shouldn't be two or three. The democratic, the party is sovereign, it goes to the election.

To be elected, the only requirements are: Three years of membership and paying dues, which are the main requirements.

That's what I said, just go and visit the Statutes. They are the Statutes. We have nothing else that governs, because we have the Statute.

So, now, at this stage, for example, Alberto Pereira has this precautionary measure and others want, for example, the second round, what do we expect here?

Well, the president expected Alberto Ferreira to respect the Party's issues in terms of not only the statutory components, but also the rules of the instruments they choose to resolve conflicts or internal matters. So this means that he went beyond all procedures, which is a bit complicated.

So, we are here in the middle of two dilemmas. A candidate who resigned because he does not accept the second round, and the candidate who is going to submit to a measure, without first respecting the Party's instruments. He went through the president, the secretary general, the secretariat, the political council, all these instruments and went to court.

We are facing a violation of an internal rule. The candidate is once again a founding member. I am not judging anyone, I am not judging but I am explaining what happened.
